The rules that keep the service fair and reliable.

By downloading, accessing, or using the Voice Recorder app ("the App") or our related services, these terms will automatically apply to you. Please read them carefully before using the App.

You are not allowed to copy or modify the App, any part of the App, or our trademarks in any way. You may not attempt to extract the source code of the App, translate the App into other languages, or make derivative versions.

The App itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, belong to Smart Mobi Tools - Jakub Bartuś ("we", "us", or "our").

To maintain security, limit data retention, and protect the privacy of our users, Voice Recorder accounts are generally deleted after 365 days of inactivity.

Inactivity means the user has not connected to the Remote Recorder service using the Voice Recorder app or website. An internet connection is required for an account to be registered as active.

Content stored locally on a user’s device prior to account deletion will remain until the App is deleted from the device. Once a cloud account is deleted, all associated cloud recordings are permanently erased.

Our Services allow you to record, upload, and store audio and text ("Content"). You retain full ownership of the Content you create. However, by using our Services, you agree that you will not record, upload, or share any Content that:

• Is illegal, threatening, abusive, harassing, defamatory, or discriminatory.
• Violates any third-party rights, including intellectual property rights, privacy rights, or publicity rights.
• Contains malicious software, viruses, or any other harmful code.

Because we prioritize your privacy, we do not actively monitor or listen to your private recordings. However, we reserve the right to suspend or terminate your account and delete your data if we are notified by our cloud providers or law enforcement that your account is being used to store illegal material or is otherwise violating these Terms.

By enabling or using the AI generative features in this application, you acknowledge that all content produced through this functionality is automatically generated and may not always be accurate or complete.

You are fully responsible for reviewing, evaluating, and verifying any output before relying on it or taking action. We do not guarantee the suitability of AI-generated content for any particular purpose, nor do we accept liability for any claims, damages, or losses arising from its use.

You agree to comply with all applicable laws and regulations when utilizing these features, and to respect any third-party rights that may be impacted by the generated content. If you have concerns regarding legality or suitability, you should seek professional advice before proceeding. Your continued use of the AI generative features signifies your acceptance of these conditions.

We try to keep the Services up and running and free of annoyances. But we make no promises that we will succeed.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND TO THE EXTENT PERMITTED BY LAW WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

While we attempt to provide a good user experience, we do not represent or warrant that the Services will always be secure, error-free, timely, or free from delays, disruptions, or imperfections, or that any content, user content, or information obtained on or through the Services will be timely or accurate.

Neither we nor our affiliates take responsibility or assume liability for any content that you, another user, or a third party creates, uploads, posts, sends, receives, or stores on or through our Services. You understand and agree that you may be exposed to content that might be offensive, illegal, misleading, or otherwise inappropriate.

To the maximum extent permitted by law, we and our managing members, shareholders, employees, affiliates, licensors, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, punitive, or multiple damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

This applies to claims resulting from your access to or use of the Services, inability to access or use them, the conduct or content of other users or third parties, or unauthorized access, use, or alteration of your content, even if we have been advised of the possibility of such damages.

Some jurisdictions, including certain EU member states, do not allow the exclusion or limitation of liability for certain damages, so some of the above limitations may not apply to you. In no event will our aggregate liability for all claims relating to the Services exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

We may update our Terms of Service from time to time. You are advised to review this page periodically for any changes.

We will notify you of any changes by posting the new Terms of Service on this page, and we may also notify you via an in-app notice. These changes are effective immediately after they are posted.

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
